Overview:

Most businesses need to be approved as a Standard Business Sponsor (SBS) in order to sponsor Temporary Skill Shortage (482) and other types of temporary work visa applicants. SBS approval is available for businesses both inside and outside of Australia, subject to different rules and obligations.

Requirements:

There’s a number of requirements that Australian businesses need to meet in order to be approved as an SBS.

  • There is a properly established business structure – such as a company, trust, partnership or registered business name; and
  • The business must be in a sound financial position
  • Business must be lawfully operating

Standard Business Sponsor status, once approved, will usually last for 5 years, except when:

  • Your business has been operating for less than 12 months – your SBS status will last for a maximum of 12 months

High volume sponsors with many sponsored applicants as employees can apply to have their SBS status extended to six years as an accredited sponsor.

Limits on number of sponsored employees:

Employees must specify the number of employees that will be sponsored during the validity of the sponsorship. The number of employees requested will need to be justified and the Department of Home Affairs may specify a lower number if they feel it is warranted. If your limit is reached during the SBS period, you’ll need to apply for a variation of the sponsorship to be able to sponsor further employees. Additional Information for Businesses outside of Australia:

If your business is registered and operates outside of Australia, you must be seeking to employ a skilled worker to either:

  • Establish, or help establish, a business operation in Australia
  • Fulfil obligations for a contract in Australia

Overseas businesses seeking to setup operations in Australia have a maximum sponsorship period of 18 months, while businesses seeking to fulfil contract obligations in Australia have up to five years.
